Acceptance of Terms
By accessing or using LuxHalo Intelligence (“LuxHalo,” “we,” “our,” or “us”), you agree to be bound by these Terms & Conditions.
If you do not agree with these Terms, please discontinue use of the service.
About LuxHalo
LuxHalo is an AI-powered Ambient Companion Computing platform designed to provide calm, reflective, and productivity-focused digital experiences through conversational AI, voice experiences, journaling, atmospheres, and related features.
LuxHalo is intended to support reflection, organization, creativity, productivity, and conversation.
LuxHalo is not a substitute for professional medical, legal, financial, mental health, emergency, or other professional services.
Eligibility
You must be at least 13 years old, or the minimum age required by applicable law in your jurisdiction, to use LuxHalo.
By using LuxHalo, you represent that you meet the applicable age requirements.
User Accounts
You may be required to create an account to access certain features.
You are responsible for maintaining the confidentiality of your login credentials and for all activity occurring under your account.
You agree to provide accurate and current account information.
Acceptable Use
You agree not to:
Violate any applicable laws or regulations.
Attempt unauthorized access to systems or accounts.
Disrupt or interfere with the operation of LuxHalo.
Upload malicious software or harmful code.
Use LuxHalo to harass, threaten, abuse, or harm others.
Use LuxHalo for fraudulent or deceptive activities.
Attempt to reverse engineer or exploit LuxHalo systems.
AI Responses & OpenAI Processing
Halo generates responses using OpenAI technology.
By using LuxHalo, you understand that messages, prompts, conversation history, journal content shared with Halo, and voice transcripts may be transmitted to and processed by OpenAI in order to provide AI functionality.
AI-generated responses may be inaccurate, incomplete, outdated, or incorrect.
You should independently verify important information before relying on it.
LuxHalo does not guarantee the accuracy, reliability, or completeness of AI-generated content.
Halo is intended for reflection, organization, creativity, productivity, and conversation and should not be relied upon as professional advice.
AI Consent
By using Halo, you acknowledge and agree that content you choose to share with Halo may be processed by OpenAI in order to provide AI functionality.
This may include:
Messages and prompts
Conversation history
Journal content shared with Halo
Voice recordings and transcripts
Related context required to generate responses
Your use of Halo constitutes consent to this processing as described in our Privacy Policy.
Journal Content
You retain ownership of journal entries, reflections, and content you create within LuxHalo.
By using LuxHalo, you grant us the limited rights necessary to store, process, and display your content in order to provide the service.
Voice Features
Voice features may use OpenAI speech recognition, transcription, and voice processing services.
When Voice Mode is used, audio recordings, voice transcripts, and related content may be transmitted to OpenAI in order to provide transcription, conversational AI, and voice functionality.
By using Voice Features, you consent to the processing of voice data necessary to provide these services.
Subscriptions
Certain LuxHalo features may require a paid subscription, including LuxHalo Plus.
Subscription benefits, pricing, and feature availability may change over time.
Subscription fees are billed according to the plan selected at purchase.
Failure to maintain an active subscription may result in loss of access to premium features.
For subscriptions purchased through Apple’s App Store, billing, cancellations, and refunds are governed by Apple’s policies.
Refunds
Refund requests are handled according to the policies of the applicable payment provider and applicable law.
For subscriptions purchased through Apple’s App Store, refunds are subject to Apple’s refund policies.
Intellectual Property
LuxHalo, Halo, LuxHalo Intelligence, logos, branding, atmospheres, visual designs, software, and related materials are protected by intellectual property laws.
Except as expressly permitted, you may not copy, reproduce, distribute, modify, or create derivative works from LuxHalo content without permission.
Service Availability
We strive to provide reliable access to LuxHalo, but we do not guarantee uninterrupted availability.
Services may occasionally be modified, suspended, or unavailable due to maintenance, technical issues, upgrades, or circumstances beyond our control.
Termination
We may suspend or terminate accounts that violate these Terms or engage in activities that threaten the security, integrity, or operation of LuxHalo.
You may discontinue use of LuxHalo at any time.
Disclaimer of Warranties
LuxHalo is provided on an “as is” and “as available” basis.
To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
Limitation of Liability
To the maximum extent permitted by law, LuxHalo and its operators shall not be liable for indirect, incidental, consequential, special, or punitive damages arising from your use of the service.
Our total liability shall not exceed the amount paid by you to LuxHalo during the twelve months preceding the claim.
Indemnification
You agree to indemnify and hold harmless LuxHalo, its operators, affiliates, and service providers from claims, liabilities, damages, losses, and expenses arising from your use of the service or violation of these Terms.
Changes to These Terms
We may update these Terms & Conditions from time to time.
Updated versions will be posted on this page with a revised effective date.
Continued use of LuxHalo after changes become effective constitutes acceptance of the revised Terms.
Governing Law
These Terms shall be governed by and interpreted in accordance with the laws applicable in the jurisdiction in which LuxHalo operates, without regard to conflict of law principles.
